Your feedback could be implemented in our next collection! register your bag. 2017 Jack Spade Wear Test Program – Terms & Conditions 1. Description.  The 2017 Jack Spade Wear Test Program (the “Program”) begins at 00:01 am ET on June 1, 2017, and ends at 11:59 pm PT on September 30, 2017 (the “Program Period”).  By participating in the Program, participants (or, if a minor in their place of residence, the participant’s parent or legal guardian on his or her behalf) unconditionally accept and agree to comply with and abide by these Terms & Conditions and the decisions of Jack Spade, a division of Kate Spade, LLC, 2 Park Avenue, New York, New York 10016 (the “Sponsors”), which shall be final and binding in all respects.  2. Eligibility. To be eligible, participants must have purchased one of the following styles, Mason Leather Backpack, Mason Leather Zip Messenger Bag, Tech Oxford Field Messenger Bag, Tech Oxford Slim Brief, Nylon Twill Backpack, Nylon Twill Gym Duffle Bag, listed on www.jackspade.com/wear-test-program. Must be eighteen (18) years of age or older at the time of participation, a legal resident of the fifty (50) United States (including the District of Columbia), and must have signed up to receive promotional e-mails from Sponsors.  Employees, officers, and directors of Sponsors, their respective parents, affiliates, subsidiaries, and agents, as well as the immediate family (defined as parents, spouses, children, siblings, and grandparents) and household members of each of the foregoing are not eligible.  Void where prohibited by law.  All federal, state and local laws, rules and regulations apply. 3. How to Participate.  Once you have purchased and received your bag from www.jackspade.com/wear-test-program you must follow the instruction card included with your order and visit www.jackspade.com/wear-test-program-register and complete a registration form in its entirety, including your valid e-mail address, Product Serial Number (found on card) and any feedback you may have (collectively, the “Entry”).  Incomplete Entries and those containing invalid e-mail addresses will be disqualified and removed from the Program.  LIMIT ONE (1) REGISTRATION PER PRODUCT.  But there is no limitation on sharing your feedback with us. 4. Rights in Entry. By submitting an Entry (either through form submission or by email to weartestprogram@jackspade.com), each Participants acknowledge and  agree that the Entry and any information or materials contained therein shall become the exclusive property of Sponsors and may be freely used by the Sponsors without any limitation or compensation, and will not be acknowledged or returned.  By participating in the Program, each participant  (and any minor participant’s parent or legal guardian)  grants Sponsors (and its respective designees) the right to use participant’s name, likeness, photograph, address, biographical information and statements for any purpose, including but not limited to advertising, promotion and publicity of Sponsors, and their goods or services and the Program, in any and all media now or hereafter known throughout the world in perpetuity, all without further consent from or payment to participant. 5. General Release & Force Majeure. By participating in the Program, each participant (and any minor participant’s parent or legal guardian) agrees to be bound by all terms of these Terms & Conditions and releases, holds harmless, covenants not to sue, and forever discharges Sponsors, and each of their respective parent companies, affiliates and subsidiaries, retailers, divisions, advertising and promotion agencies, and all others associated with the development and execution of this Program, and each of their respective directors, officers, employees, agents, shareholders, representatives, successors and assigns (all such individuals and entities collectively referred to herein as, the “Released Parties”), from, against, and as to any and all third-party claims, actions, damages, losses, liabilities, costs, expenses, injuries or causes of action of any kind that in any way now or hereinafter may arise from or relate to the Program.  Without limiting the foregoing, in the event Sponsors are prevented from continuing with the Program as contemplated herein by any event beyond its control, including, but not limited to, fire, flood, epidemic or other national health emergency, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared,) or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, public health crisis, or other cause not reasonably within Sponsors’ control, then Sponsors shall have the right to modify, suspend, extend or terminate the Program. 7. Miscellaneous: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms & Conditions, or any rights and obligations of the participants and Sponsors relating to this Program, shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules that would cause the application of any other state's laws. By entering this Program, each participant agrees that any and all disputes, claims, and causes of action arising out of or in any way related to this Program shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in Manhattan, New York. Without limiting the scope of any legal release provided herein, except while prohibited, under no circumstance shall any participant be permitted to seek or obtain and, by entering this Program, each participant waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
